                   	     ORDINANCE NO.   9848 
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING PINE STREET
                   LOCATED SOUTHWEST FROM IGOU GAP ROAD, BETWEEN
                   AVAKIAN DRIVE AND CEDAR STREET,  MORE
                   PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN
                   CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned Pine Street located southwest from Igou Gap Road, 

         between Avakian Drive and Cedar Street, more particularly
         described herein, and as shown on plat attached hereto and made 
a
         part hereof by reference:
                   Pine Street, a 30 foot wide unopened
                right-of-way beginning on the southwest line of
                Igou Gap Road 420 feet northwest of the
                intersection of the southwest line of Igou Gap Road
                with the northwest line of Avakian Drive, and
                extending southwest some 265 feet between parallel
                lines, and parallel to Avakian Drive, to the
                southwest corner of lot 27 and the southeast corner
                of lot 26, Nelson's Subdivision, not recorded. Said
                street separates lots 26 and 29, and part of lot
                32, from lots 27 and 30, and part of lot 33, said
                Nelson's Subdivision.  Tax Map No. 159G-E-11 and
                13.
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:

                1. The City of Chattanooga has a sewer located
                   within said right-of-way and reserves an
                   easement the width of the right-of-way for the
                   purpose of maintaining said sewer.
               
                2. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                3. All existing easements are retained.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
